NKS Cleaning and New Client Agreement

This Payment and Service Agreement (“Agreement”) is entered into by and between NKS Cleaning (“Service Provider”) and ____________________________________________ (“Client”) as of ____________________ (“Effective Date”). This Agreement sets forth the terms under which NKS Cleaning will provide cleaning services to the Client.

2. Services Provided

NKS Cleaning agrees to provide cleaning services as requested by the Client and agreed upon before service begins. Services may include general cleaning, dusting, vacuuming, mopping, kitchen cleaning, bathroom cleaning, trash removal, surface disinfecting, and other tasks agreed to in writing.

3. Schedule and Access

The Client agrees to provide safe and timely access to the service location, including keys, entry codes, parking instructions, alarm information, and any pet or security instructions as needed.

4. Payment Terms

The Client agrees to pay NKS Cleaning the following amount for services:

Late payments may be subject to a late fee of $______________ or ____% of the unpaid balance if payment is not received within ____ days after the due date. NKS Cleaning may pause or cancel future services until all past-due balances are paid.

5. Supplies and Equipment

Cleaning supplies and equipment will be provided by: ____________________________________________. If the Client requests specific products, eco-friendly products, fragrance-free products, or special equipment, the Client must notify NKS Cleaning before the service date. Additional charges may apply for specialty products or equipment.

6. Client Responsibilities

The Client agrees to provide accurate service instructions, remove or secure fragile or valuable items, disclose any hazards at the service location, secure pets as needed, and ensure that utilities such as water and electricity are available during the service appointment.

7. Cancellations and Rescheduling

The Client must provide at least ____ hours notice to cancel or reschedule a service appointment. Appointments canceled with less than the required notice may be subject to a cancellation fee of $______________. If NKS Cleaning arrives and cannot access the service location, the Client may be charged a lockout or missed appointment fee of $______________.

8. Satisfaction and Service Concerns

If the Client has concerns about the completed service, the Client must notify NKS Cleaning within ____ hours after service completion. NKS Cleaning will review the concern and may, at its discretion, correct the issue, provide a service credit, or offer another reasonable resolution.

9. Remedy First and No Withholding of Payment

If the Client has any complaint, concern, or dissatisfaction regarding services performed, the Client agrees to first allow NKS Cleaning a reasonable opportunity to remedy the issue. The Client must promptly notify NKS Cleaning of the concern and cooperate in scheduling any reasonable corrective action. A complaint, service concern, or request for remedy does not excuse, delay, reduce, or justify withholding payment for services already performed, unless otherwise agreed to in writing by NKS Cleaning.

Any unpaid balance that results in a dispute filed in small claims court will be subject to all court costs permitted by law. Any discounts previously offered for services will no longer apply to the unpaid balance. The Client will also be responsible for a $500.00 administrative and preparation charge to compensate NKS Cleaning for the time required to prepare the small claims matter, to the extent permitted by law.

10. Damages, Liability, and Safety

NKS Cleaning will use reasonable care while providing services. The Client must report any alleged damage within ____ hours of service completion. NKS Cleaning is not responsible for pre-existing damage, normal wear and tear, improperly installed items, unsecured valuables, or damage caused by undisclosed hazards. NKS Cleaning may refuse to perform work that is unsafe, unsanitary beyond the agreed scope, or outside the services described in this Agreement.

11. Term and Termination

This Agreement begins on the Effective Date and continues until completed or terminated by either party. Either party may terminate recurring services by providing ____ days written notice. The Client remains responsible for payment for all services performed and approved charges incurred before termination.

12. Independent Contractor Relationship

NKS Cleaning is an independent service provider and is not an employee of the Client. Nothing in this Agreement creates a partnership, joint venture, employment relationship, or agency relationship between the parties.

13. Communications Consent

The Client authorizes NKS Cleaning to communicate by email, text message, telephone call, and postal mail regarding invoices, receipts, payment or service reminders, scheduling, and other matters related to the services. NKS Cleaning may occasionally send marketing materials through these methods, but such communications will be kept to a minimum.

14. Limited Use of Photographs

The Client authorizes NKS Cleaning to take and use photographs of the home to document and verify completion of services and for advertising and promotional purposes. Before use, NKS Cleaning will remove or exclude identifying information associated with the photographs, including geolocation data, addresses, names, recognizable personal documents, and other details that could reasonably identify the Client, occupants, or property. The Client’s and occupants’ identities will be kept private. The photographs will not be sold or licensed, and no direct revenue is expected to be generated from the photographs; they are intended only as proof of completed services and to advertise NKS Cleaning’s services.

15. Entire Agreement

This Agreement represents the entire understanding between the parties regarding the cleaning services described above. Any changes to this Agreement must be made in writing and approved by both parties.

16. Signatures

Acceptance Without Signature: The Client acknowledges and agrees that requesting, authorizing, accepting, or receiving services from NKS Cleaning constitutes acceptance of and agreement to all terms of this Agreement, even if the Client does not sign this Agreement.
